What is identity theft?

In the payments industry identity theft is a big problem.

A friend stopped by my office yesterday and asked an interesting question.  “What is identity theft?”  A good question given today’s information economy.  Is it OK to take someones name and phone number or other information and use it.  What if I don’t actually use anothers information but just sell it? 

How much can I sell before doing so constitute identity theft?  What if I include the birth date?  What if I sell the birth date, gender, income level without a phone number or name?  Does selling anothers information constitute identity theft? If so, when? 

Many business today gather and sell information and aren’t considered identity thieves.  So when does it be come identity theft?
